My husband bought 80 acres 40 years ago. He put the property in an estate. I am his only living heir. I live far away from the property and have not seen it in years. I leased it to a farmer several years ago and he has filed a quiet title deed to take the property. What can I do? Can you help?
"I leased it to a farmer several years ago"
if you can specify this several years ago in terms of number of years then it will be easy for the legal course as in most of the cases it depends upon the no of years.

Hi sherrybufford,
As the farmer you leased the property to has already filed a quiet title lawsuit, you should immediately contest the lawsuit with all your proofs of ownership on the said property. I think you should immediately consult an experienced real estate attorney to guide you further in this regard.

He filed the quite title in 2006 he got the 80 acres in court because i was not notified about the lawsuit what can i do its been 2 and half years he stole my land how can i get it back. All he has is a judgement he does not have a deed or anything saying he owns the land i checked the courthouse the land is still in my husbands estate.can i pay my taxes? can i file a quick clam deed.
hi sherry,
filing a quit claim deed won't help. it is used to transfer property from an individual to another and i don't think the farmer now would be willing to sign over his rights to you through quitclaim. the best thing to do for you is to consult a lawyer and contest the validity of the judgment on the ground that you were never notified about the lawsuit.
