What are my legal rights to the house I am living in if my parents have passed away and their name is on the mortgage but mine is only oon the deed not on the mortgage and how would I file taxes on it in 2011...I don't know what me legal rights are concerning the house I am now living in. Both of my parents have passed away and their name is on the loan. My name is not on the loan but it is on the deed. I don't know what to do about the taxes on the property for 2011.
i believe you will have to refinance the home under your name if you can get approved. you will probably have to provide death certificates as well.

You have to make sure how you took title to the property with your parents. The deed will be very specific, tennants in common, Rights of survivorship.....

Depending on on you took title, the properties interests may depend on the will and estate of your parents.
