How do you know if Lien exists on house?

I guess I know the only answer for sure is to have a title search (howmuch?) but isn't odd that there is no easily accessible record. For example, it seems as if it is possible for a lien to be placed against my house without me knowing it. I find this hard to believe. When a lien is recorded isn't there some mandatory notification to the owner? What prevent some fraud from putting a lien on the house?

Let me try to answer your queries...

A lien can only be placed if it can be proved that you actually owe on the debt and haven't repaid it. So a fraud will not be able to do that.

You can search the county record's yourself to see if any liens exist on your property.

A notification is sent when a lien is placed. Has it happened with you that you came to know of a lien but did not receive any information about it?

You can expect to pay around $300-$350 for title search. But prices do vary a lot on state to state basis.

Tom, courts normally send summons by certified mail, return receipt requested before the proceedings start for placement of a lien on the property.

No one can place any lien upon your property without your knowledge or awareness. Before placing it, one needs to provide a notice as requested.

Hi Tom,

Welcome to the forums.

In order to find out if there is a lien on property, one can go through public records kept at the County Recorder's office. He can even meet the county recorder in person and seek his help in finding out if there is a lien placed on his property.

However, even if someone places a lien on a person's property by fraud, you can get rid of it by the help of your owner's title insurance policy, provided you have paid for one. In fact such a policy helps buyers and protects them from potential liens, if any against the property.
