I am being asked to pay an additional amount for a company to determine whether or not my manufactured home was ever issued a DMV title. We purchased the home already on acreage and the transaction was handled as a Real Estate Contract. There are no separate titles for land and home...all was done as one real estate transaction. The HUD plates are on the outside and indoor tag is in the home. A title search was done on the property, etc. but during this refinancing I am being told I have to have a "title" to the home...which we never have had. Is this legal? and if so, how do I obtain the original certificate of title?

You can directly contact the Department of Motor Vehicles (DMV) in order to get a duplicate copy of the title for your property.

Actually, once the title is surrendered the "mobile" home becomes real property and not anything that the DMV registers - at least in Texas. That said, you can probably check with the title company who insured the transaction when you made the purchase to see if they have the records of this being surrendered, etc. They should have all that on file.
