My Husband & I live in Ga. & own 2 houses that are paid for. We have worked very long & hard towards getting out of debt and to pay off these properties. My husbands health has gotten bad and he's at least 9 years out from drawing Soc. Sec. He will soon loose his medical insurance and this will be a disaster for us & what ever we own. I've been told he can't get medical assist. or medicaide with owniing property or they will take the property. Also, the fear of having medicla liens put against the houses.
If I put the property in my name would they still count the property against him because we are married? We live in one house and our Son, daughter-in-law and grandkids live in the other. They pay the taxes, insurance and the upkeep for us.

Hello Kathy. Welcome to the forums.
The state law varies from one state to another. If your husband quitclaims then he may not be eligible to get the Medicaid facilities. So I think your husband can use a Ladybird deed. Consult with an attorney to know whether he will remain eligible if he transfers the property to you with the help of a ladybird deed
