My dad wants to transfer the house into my name. He does not want the state to get it should my mother be put in a home. they have medicare A, and my mother is in hospice care. can the state take the house even though it is in the will that it goes to me?
Hi krschulz!

If the property is in your father's name, then the medicare will not be able to come after the property though your mother is in hospice care. This is because your mother's name is not on the property deed. Your father can transfer the property to you using a ladybird deed. The property will be considered as exempt if the spouse or any relative occupies it when your father is not around. For further advice on this regard, you can consult a real estate attorney.
Feel free to ask if you've further queries.
