My partner of 16 years has asked me for a divorce. (same sex couple) We purchased our home in 1997. My partner had sold a house in another city and she did put down most of the downpayment. I put in a share as well. This was never noted. My name did not go on the deed at the time. We had a son in 1999 and I have been the stay at home Mom for the last 11 years. We agreed I would be the full time caregiver while my partner worked. In 2002 my name went on the deed. Now I hear that I may have no interest in our house? I realize I have not contributed moneteraly into our house, however, I have been the "wife" and have kept our home, paid all of the bills and raised our son. I guess this does not count? Am I considred a second class citizen because I chose to be the Mom?

Don't think yourself to be a second class citizen just because you chose to be a Mom! Very few people can provide the right type of care to a child, isn't it? :-)
You would be able to receive the community interests in the property if the payments towards the mortgage has been made using the community funds. As that hasn't happened, I think you won't have interest in the property. Nevertheless, I would suggest you to contact an attorney and get his opinion in this matter. He'll be the best to let you know whether or not you'll have interest in the property.

I personally don't consider myself a second class citizen. I am quite proud of having had the opportunity to be our son's full time, stay at home Mom. It is my partner who agrees with many folks out there who give very little thought to the value of a Stay at Home Mom. As an FYI the mortgage payments etc. have been made from a joint acount. Community funds indeed. Thanks

If the mortgage payments have been made from the joint account, then you should have community interest in the property. I would suggest you to contact an attorney well versed with the community property laws of your state and take his opinion in this matter.

You say your name is "on the deed". Why do you then say you have no property interest?
