Divorce-on deed but not loan, moving out, want equity

Posted on: 11th Sep, 2013 10:58 pm
In the middle of divorce, husband wants me to agree to take my name off deed for Temporary Orders by the time of Final divorce decree. Can I still be entitled to a set amount of equity(buyout) as long as I haven't signed quitclaim or IST yet?
Once you sign the deed, you will not be able to claim the equity in that property. In such a situation, it will be better if you could get in touch with your attorney, take his opinion and then sign the deed.

Hi Hayley,

Niicss is right. Do not sign any documents before consulting your attorney. You may lose out on your claim toward the equity in the property.

Thanks
