By the way the home is in his name but I am on the deed and county tax records not on escrow
Hi wbmcintosh!

Welcome to forums!

If your name is mentioned on the property deed, then you'll be considered as one of the owners of the property. You will be able to claim that property to be your. However, whether or not it's a community property will depend upon your state laws.

Feel free to ask if you've further queries.
