i thought i was on my deed but iam not

Hi
When my hub and I purchased our house my name did not go on the mtg due to old debt problem with x boyfriend, but i didnt realize my name did not go on the deed..it was mydown pymt, and the front of the deed cover letter from the attorney has my name but not on the recording side..I paid the mtg every month and signed all the checks etc..the mtg is almost paid..I called the bank and they told me theywill send me a form to add my name onto so the title is in both of our name..do I need this notarize and signed by my hub..he is giving me problems and I dont know if he will agree to do that..i want to know my rights..how do i get my name on there..i called the original attny and she said that is how the bank put it..no one is looking to correct this for me..i am upset by this..any solutions please..
Hi I posted the previous question .. I live in ny..and I live in the house for almost 15 years..mtg almost paid off..but no where is my name on the deed except the front of the cover letter from the deed from the attny who closed..my downpayment etc..I never noticed before until now..only hubs name on the recording side in writing..help what do i do..he is not willing to change it now..control issue's..yet i have paid for the house to run etc..The bank is mailing me a form so that when the mtg is paid off i can add my name to the title and that will get recorded to the new deed or title..once the house is paid off do we get a new deed or title for the house..help..please..teri..previous post..

I can understand the problem you are facing and hope that you quickly come out of it. I think you should wait for the bank to send you a form to add your name onto the title. Once this happens, I think your issue will be resolved. Once the mortgage is paid off, you will receive a release deed from the bank's end with a file stamp with a document number, recording date and other information from the Recorder's Office. In case these information is not there, submit the deed to the Lake County Recorder of Deeds Office for recording. And also check if your name is on the deed or not.

If your name is not on the deed, you will have to take legal steps for which you need to consult an attorney.

I got the papers today from the bank..Very confusing..if it is to be joint deed..what type of deed is this..we have no will. we have a 8 year old son..should his name be on there...I want to make sure my spouse cannot sell the house from under me..Someone really messed up with this..the papers are very confusing..thanks..

My name is on the cover side of the deed but not the written side..i called the clerk and it is only in my spouses name..can i prove that they messed up..I found checks showing I paid the mtg etc..and put the down payment down..any info would help to resolve this..thanks again

Welcome back to Forums!

I don't think you can include your son's name in the title as he is still a minor. As you have got the checks showing that you have paid the mortgage, you can consult an attorney. Take the form and the checks along with you so that the attorney could see to it and decide what to do.

Do I need a will too..we dont have one..I want to make sure my son would get his entitlement when he turns 18 God forbid something would happen to either one of us..as for the papers from the bank I will fill that out Iam just not sure what type of deed I check off on it..quiet, etc..thanks again for your help..I appreciate it so much..Iam disabled and was wondering do they have attorneys for people with low income and disabled in ny..do u know..thanks and God bless..

Yes, it will be excellent if you have a will which will state that if anything happens to you, your son will be the owner of the property you own. You can consult an attorney for this. I have heard of a Modest Means Program which offers help to people in certain situations. You can avail that option.
