can your name be taken off of the deed without you signature

our family home deed which was in all four of the childrens name was sent to my sibling and myself to sign over to the other 2 siblings. we did not sign our part over, then about 6-9 months later another deed was sent to us without our name on it. It had been transfered to our other siblings without our permission. Can this be done. We have contacted a attorney and he is looking into this for us. how can you be given something and then it taken away? the deed is in the deed court registered, i have a feeling they could no do this without our signature. please advise me. thank you.J

As far as I know, your signature is needed in order to transfer your portion of the property to your siblings. They cannot even force you to sign something. Its good that you have engaged an attorney for this purpose. You can even sue your siblings for this.

My elderly mother and one of my brothers transferred the deed to my mothers home into his name and my mine without my knowledge or signature. We hve 5 other siblings and I wanted all their names to be on the deed, but my brother refused (and I'm thinking it's because he gets the tax benefits). However, it has gotten to the point that having such an asset in my name is hindering me from taking advantage of some of the home modifications programs that are available to me on my own home. I now want to transfer my half of the ownership to another sibling and still my brother who signed my name to the house in the first place is refusing to cooperate to take my name off. My question is, do I need his permission to transfer my share to another sibling. I believe we are equal partners on the deed, I guess joint ownership. It's not tenants in common. Any advise you give will be very helpful.

Your do not need your brother's permission to transfer the property to your sibling. You should sign a quitclaim deed in the favor of the sibling to whom you want to transfer the property. You can take the help of a real estate attorney in this regard.
