Name off deed

Posted on: 31st Mar, 2009 10:51 am
a non married couple, both names on deed. One person wants to remove the other and everything about the house is in that one persons name and she allowed him to be on the deed. But no longer together. Can a court remove his name? He won't sign it to take name off?
What are the other options?
Welcome Elaine,

She will have to ask him to sign a quitclaim deed in her favor. If he is not ready to sign the deed, then she can buy him out by offering a certain amount of money. If he is still not ready to remove his name from the deed, then she can file a partition lawsuit and sell off the property. The sale price will be used to pay off the mortgage first and rest of the amount, if any, will be divided between both of them.

Hi

Unfortunately, you aren't left with too many options. If he is not willing to sign the deed, you will have to either buy him out or go for a partition lawsuit which will enable you to sell the proeprty and divide the proceed among the two of you.
