Interest in property

Posted on: 27th Dec, 2010 04:59 pm
My father lives on property that is in his brother and sisters name. They have both recently passed away. My father has paid the taxes on the property in care of since 1974. I have power of attorney for my father and would like to transfer his interest in the property to me. His sister left a Will dividing her interest in the property to my father and 3 siblings (including the uncle that recently passed away). My uncle passed away without a Will. Probate will not be easy as the surviving siblings have to responded to my inquiries. My father is up in age. What is the best type of filing for me to do in case my father passes on that would give me his interest in the property should it go to probate?
Hi Fernando!

Welcome to forums!

As there are will, you and your father will have to probate it. You should contact a real estate attorney and take the required steps to probate the will. Once the probate is complete, the property will be transferred to your father. Then, your father can sign a quitclaim deed and transfer the property to you.

Feel free to ask if you've further queries.
