my husband and i were in a lease with an option to own the home we are currently living in. we then found out aprox one year later that he had not paid property taxes for 3 years (they were not included in his loan) and had stopped paying the house pymt even though w were paying him our rent each month, and the house was going into foreclouser. to stay in our home, we paid all the back taxes and brought the morgage up to date. in return he signed a quitclaim over to us we paid him 500.00. we kept the morgage in his name because we could not qualify for the loan.we have been paying the morgage on time ever since (last 4 years). now suddenly he wants us to put the title back in his name so he will be protected in case we die and has offered to refinance the home so we can have a lower pymt.i dont want to do this as it seems that we would have no protection if he wanted to sell or if he dies. he is insisting on this and wants us to go to the court house asap.the loan co, also called and said in order to refinance the deed must be put back in his name. my question is should we do this and can two non related people be on the deed in missouri to this house so we could be protected.

No one can force you to add their name to the property deed. If you want to lower the payments, then you can refinance the mortgage in your name. Nevertheless, it will be better if you could contact a real estate attorney and take his opinion in this regard.

I agree with what Sussane has said. You should contact a real estate attorney and take his/her opinion in this matter. It is not mandatory for you to add someone to the property deed.

To be in the mortgage deed, two persons should not necessarily be related to each other. Two completely alienated persons can in in a mortgage deed.
You must refinance the property in your name or sell it. If you give back the home, you will effectively lose all the money you have put in it.
You have done so much to save the house, so risking it to go in some other hands should not be done. Contact a higher authority and take the proper action accordingly.
