My aunt passed away in late october with no will & insurance. she is survived by a minor child of whom I have assumed guardianship over. my aunts husband passed away several years before she did. she still owed money on the trailer she was buying. i enturn paid for her funeral expencies & paid off the remaining balance owed on her trailer. Now I wish to sell the property and I am being asked for a document showing that I am allowed to sell the property.

In order to sell off the property, you should be the owner of it. I guess there is no will or no documents which shows that you're the owner of the property. In that case, you'll have to file an affidavit of heirship at the county recorder's office and get the property transferred in your name. Once the property is in your name, you can sell it off.

That means her Estate needs to go through Probate, so that her Estate can be legally transferred to her heirs. That needs to happen first. During the Probate process, somebody is going to receive Title to her home, and that person (or people) is the only one who's allowed to sell it.

mother died with no will and no estate. But a check was sent to us in her name from some kind of settlement account. How can we cash the check to divide among the adult children?
You'll need to established a "Trust" account at your local bank. Be sure to bring an original death certificate - the bank will need to keep a copy of it. Close the Trust account after you feel all checks that could possibly arrive in her name have been delivered.
