My Dad's dad and my Dad's brother both owned land in KY. They both passed away without leaving a will. The closest living realatives are my dad and another brother. His brother has no interest in the property. The property was listed in the newspaper to be sold at a sheriff's sale due to non-payment of propery tax. My Dad paid the back tax.
It depends on what state you are in. You should contact an estate or probate attorney. Since they had no will, the law will establish the heir to the land by statute; it is called "intestate succession". It usually goes to the closest relative. The attorney will have to help you go to court and legally transfer title to you, if you are the heir.
Hi Russsmith,
Welcome to this forum.
If someone dies in the family without a will, it is said that he has "Instate". You should contact with an Intestate Succession attorney. He will help you to transfer the property to the closest inheritor that means to your father.
Hope it will help you.
Thanks,
Larry
