how can i take the other owner name off the title and mortgage?...i bought a house with my boyfriend and he paid the down payment, and before we actually move in to the house we broke up so i had to move by my self to the house, now its been 5 months that i live there and i pay the mortgage payment by my self, we talked together and i promised him i will give him the money that he paid as down payment but first i need to make sure that he will take his name out of the title and mortgage, so i dont really know whats the procedure should i go through in order to do that ??

Your boyfriend will have to sign a quitclaim deed in your name in order to remove his name from the property. Once the quitclaim deed is filled out, it has to be notarized and recorded at the county recorder's office. Once the property is solely transferred in your name, you will have to refinance the mortgage in your name so that your boyfriend's name is removed from the mortgage note.

If you draft the quitclaim deed from an attorney, then you will have to pay the fees to him. Apart from this, you will have to pay the recording fees, transfer taxes and doc stamp fees.

i am divorced and my exhusband needs his name off of the title/loan/note/deed, etc.....i won't be able to qualify for a loan as my credit is messed up through the divorce. what are my options?

Unless you refinance the mortgage in your name, you won't be able to remove your ex-husband's name from the loan docs. You should contact your lender and apply for a loan assumption. This will help you in transferring the mortgage in your name. However, it will be the lender's discretion whether or not the lender will agree to your request.

in divorce, there was not quitclaim deed attached in the divorce decree. my ex is not cooperative in signing a quit claim deed. i am currently working on an assumption of the loan. this will remove my ex spouse from the mortgage, but what about the title?
