what happens to my husband share of our house if he dies, but owns the house with 2 other people...The house is a 2 family house, which he owns with 2 other people, not including his wife.

If he dies, the property would be divided according to the will. However, if he presently owns the property as a joint tenancy with right to survivorship, then the other two people would inherit the property directly after his death.

Also, if your husband currently doesn't have a will and there is no right to survivorship, then his share of the property would belong to his estate if he passes away in which you would be responsible for. I could only imagine if that were to happen(Its kind of sad just talking about this, let's all hope you never really need to use this information), the other two owners would probably step up to buy his share of the property I would imagine.

If you are not listed on the title and your husband has not left a will, you need to file an affidavit of heirship with the probate court and the court will then decide who his share of property should go to as per the laws of intestacy.

One more thing. Do live in a community property state? If you do, then you do have dower rights to the property and thus, you are entitled to a certain amount of the share your deceased husband owned.
