partion sale and life expectancy

My mother gave my nephew 50% and life expectancy for her home, I was willed 50% of the home.

My attorney checked the public records and found out that my nephew's attorney never filed the actual life expectancy papers and just kept them in his office for the past 14 years? My mother has already passed away 14 years ago.

Can I still force him to partition sale the home, he refuses to give me a fair amount of $ for my 50%?
You will neeed to get hold of the original papers and get a good attorney to get this cleared in the court

I believe you can force your nephew to partition sell the house. His lawyer might not have filed the property transfer related papers. But it does not change the fact that you own 50% of the property. Now, if you want your share of the property, the other owner has to buy you out. In case, he cannot buy you out or does not offer you the right amount of compensation money, you will have the right to file a partition lawsuit in the court and force a partition sale of the house. Nevertheless, consulting your attorney is the best option for you. He is the right person to help you in this matter.
