they made the change about 6 yrs ago. we want to sell the home to help provide for their care because we have used up their savings. they are no longer living at the property. they rent an apt in nj, where they have live-in care. the ny home is presently occupied by my brother as well as two tenants. my parents don't want us to sell. do we need their signatures/ permission to sell the home?
Unfortunately your parents have to consent. The life estate only conveys to you upon their death. The purpose of the life estate is to avoid probate and to make sure the intended inherits the property.
If your parents are in care, and are unwilling to do what is nessecary to maintain their care, maybe you can be granted power of attorney and gardianship over your parents. It's a tough decision to make, but if you are making it for the right reasons....

Possibly, My advice is to contact the attorney to go over the power of attorney with you. There are different types of power of attorneys. Some can be power of attorney over health, others real estate, others financial affairs or all of the above. It really depends on how it was written.
