When two people are married and one dies, doesnt the properety automatically go to the surviving spouse?

The property does not automatically go to the surviving spouse unless they own the property as joint tenancy with right of survivorship. If the property is simply owned as a joint owners, then the surviving spouse will have to file an affidavit of heirship at the county recorder's office and get the property transferred in his/her name.
