What is the process for removing my name from the title. I am not on the mortgage.

The purpose is to purchase the home from my husband who is haivng difficulty paying the loan.

you can use a quit claim deed to transfer your interest in the house. on the deed you will be named as the grantor and he will be named as grantee.

Is it that your husband is not able to make the mortgage payments and has a buyer who is willing to purchase? And as you are also on the title for the transfer of property your name needs to be removed from the title.....

If this is the situation then a interspousal transfer deed can also be used for transferring whatever interest you have in the house over to your husband.

Hi Ann,

When your husband is facing problems to pay off the loan, it is his duty to find the solution himself as you are not included on the loan. Now, if you wish to remove your name from the title of the property, you can easily do it through the quitclaim deed and transfer your interest completely to your husband. But can you specify your purpose more clearly behind giving up the property to your husband as it is not clear from what you have written?

If you want to remove your name from the title of the property, you can sign a quit claim deed where you can transfer the interest of the house to your husband.

Is it that you wish to pay the mortgage that your husband has not been able to pay ? This is only possible if the assumable mortgage clause is there in the deed. If it is not there, then the mortgage is still in the name of your husband.
