My brother and I purchased a home 9 years ago; he passed away last year with no will. Do I own the home exclusively?
Hi mayers,
If both the names are on the property deed, then you'll have to remove your deceased brother from the deed in order to own the home solely. In order to do so, you'll have to file an affidavit of heirship at the county recorder's office.
Thanks

What if he has a child? Would this have an impact on his name being removed from the deed
If you brother has a child, then that child will be able to claim heirship of his father's share of the property. The child will want his name to be added on the deed by removing his father's name.
