If both parties are in agreement can you force a lender to release the lien on a small amount of land held on the mortgage? I need .03 of an acre from my neighbor to build on an addition to my home he is okay with selling it to me but the lending is makeing us go through a huge process and pay 500.00 and it may not even be released. We have already had survey work and legal descriptions completed.
Welcome Guest,
Unless you pay off the lien in full, you won't be able to release the lien that has been placed on the property. However, if you and the lien holder agree to a settlement, then you'll be able to release the lien. Once the lien is released, you should get a lien release certificate.
