My Dad recently passed away from a terminal illness. There is not a Will and not many assets to to sell to pay the Funeral Home. My Dad put anything he had into my brothers name a couple of years ago. Four years ago my Dad was taking care of my Grandma and drew up his own POA papers(is this legal?) to have my Grandma sign (Alzheimers). He then did a quick claim deed transfer on one of her properties, to my brother. We have 2 other siblings, I am the oldest from a previous marriage. What rights do we have? The property was not in my Dads name, being POA he quit claim to my brother. My Dad said that he is to share proceeds with us from anything that is left when he dies and said he hopes that he will be fair. My brother does not want to sell anything and is just leaving the bill unpaid to the Funeral Home and they still have my Dads ashes. Does he need the siblings to sign off if he decides to sell? That is if he doesnt lose it to the state for back taxes.
Any suggestions.. my first objective is to somehow pay the funeral home and if anything left would be helpful to the other siblings as well as myself, in this economy. Thank you..

If the power of attorney is legal, then your father can transfer the property to your brother and you and your siblings will have no claims on the property. If your brother is the sole owner of the property, then the siblings do not need to sign any document to sell off the property.
