Transfer of deed using Power of Attorney

Posted on: 10th Oct, 2010 11:04 am
Father died 1991 intestate-no will was found or ever probated. Survivors were his wife(our mother) and five of us siblings.
The main property is a private residence in Brownsville, Texas that my youngest brother has been living in for over ten years.
Mother was in rest home. In 2006 she gave me Power of Attorney, and Medical Power of Attorney, and made a will naming me the executor.
Mother passed last year (2009) in September. On February 9, 2009 my youngest brother using a Power of Attorney from 2004 that no one knew he had, transferred the deed of the aforementioned property to himself. No one knew of this until many months after mother died.
My mother executed a will, and I have been to court and named the executor. How do I get the deed put back into the estate so I can settle the estate.
Hi Janiegirl,

You need to contact a real estate attorney and take his opinion in this matter. The attorney will help you in knowing what steps you need to take in this regard so that the property can be brought back into the estate.

Thanks
