Is probate necessary

If jon and sue own the property and sue dies and jon wants to later sell the property.......Should he have to divide the money from the sale with the children?
Hi monica,

Sue's children will be considered as an heir to that property. They will have to file an affidavit of heirship and add their names to the property deed. Once they do so, they will be able to claim a certain portion of money from the sale of the property.

Were Jon and Sue married? And were they both on Title?
