Executor of Trust - husband buys property

Posted on: 27th Jan, 2009 04:30 pm
I am the executor of a Trust of five beneficiarys of which I am included as a beneficiary as well. My question is this, can my husband purchase the home from the 5 beneficiaries? Is a real estate agent required or should we do a quit claim? Four of the five sibblings live out of the U.S.
hi guest,

as far as i know, all the beneficiaries will have to agree first to sell the property to your husband. if they are ready to sell the property, then they all may use a quit claim deed or a warranty deed to transfer the property in your husband's name. in that case, i don't think a real estate agent is required.

thanks
