I purchased a house with my ex-girlfriend several years ago. Since then she has moved out and gotten married. Her name is on the deed and mortgage however she has not contributed to the home since moving out over a year ago and I have not heard from her. How can I get her off the mortgage loan and deed?
hi amy_rose71,
welcome to mortgage fit,
firstly if you are living in a community state and if you are still legally married to the lady then you can hardly do anything about it and you have to share 50 % of the property with her in any situation....
if you are not living in the community state then you may ask your ex to sign the quitclaim deed to you and you should refinance the mortgage on your name alone....
if she is not available by any means or reluctant to do it you may also get a court verdict to transfer the property rights to you....(provided you fight a legal battle)....
feel free to ask any further query if you have.............

"EX"??? I guess I missed something in the original post.
Amy_Rose...you can't simply "get" her off the mortgage and the deed. She'd have to consent to transferring her ownership interest to you, and you'd then also have to refinance the existing loan. That would give you sole ownership of the home and sole responsibility of the underlying debt.
Of course, as noted above, you could sue her in order to accomplish all this, but negotiation is much cleaner and less problematic, if you and she can agree to terms.
