HELLO, ME AND MY HUSBAND ARE SEPERATING, WE BOUGHT A HOME A YEAR AGO, ME AND THE KIDS WILL BE STAYING IN THE HOME, AND MY HUSBAND IS IN A RUSH TO HAVE HIS NAME REMOVED SINCE HE NO LONGER WILL BE LIVING THERE. WILL A QUICK CLAIM BE THE BEST FOR US? IS IT THE SAME AS REMOVING HIM?

a quitclaim deed will help your husband to remove his name from the property deed. if there is a mortgage on the property in joint names, then you'll have to refinance the mortgage in your name.

If your husband no longer wish to be on the title he can transfer his equity to any of the family menber who wishes to stay in the home...This could be a good move to add the title to any other family member who wishes to stay in the home making it more easy for you to opt for the refinance of the mortgage..(don't get me wrong but if you are planning to get remarried) then your wanna be husband can also be on the title of the home and your ex can directly quitclaim his share to the new person..
Moroever you should check out whether do you qualify for the refinance or not.It is always advisable that you should be pre-approved for these kind of loans in order to save your valuable time and money...
