Hope you can help. My Grandmother passed away leaving the deed to her home, the family home, in her eldest sons name though there were a total of six living children. Five of the six did not know that their mother had made that change and the eldest child did not mention it. Three of the six, including the deeded child continued to equally pay the taxes and repair on the home. Twenty plus years later the eldest son passes with no will. It was then that the remaining siblings found out that the deed is in his name. Now his wife has ownership, but is in no position financially to contribute to the tax or maintenance of the home. Fully aware that their name does not appear on the deed, the two siblings that had contributed regularly continue till this day out of respect for their mothers life long accomplishment and it has been over 4 years since the elder brother has passed. The wife is not oppossed to selling the property, but due to personal and financial issues will not proceed with bringing closure. Could my Grandmothers offsprings use the quick claim deed as a way to have authority and begin the process of selling or is there another way to have closure? The wife lives in Conn and the property is in Georgia. :roll:

As the property is in the name of the deceased eldest sibling's wife, she needs to sign a quitclaim deed in the favor of the other siblings. Once the quitclaim deed is signed by her, it needs to be notarized and recorded at the county recorder's office where the property is located. Once the property is transferred in the name of the other siblings, they can then sell it off.

the lady that i make my land payment to will not tell me what is owed on my property. i just want to know what the pay off is.she tells me "let me talk with my account" or let me get back to you.i dont want to upset her. im scared she might call the note due.i am not late on payments. what do i do

Welcome to forums!

If you're current on your mortgage payments, then I don't think she would call the note due. You should negotiate with her so that she lets you know what the pay off is.
