quit claim survivorship

Posted on: 16th Nov, 2008 10:00 am
My mother lives with my wife and I in our house. The mortgate is in my wife and my name. We have a quit claim that allow my mother to continue to live in the house unitl her death. She recently passed away. I don't expect any issues, but can we be responsible for any liens being placed on the house after her death due to any debts/taxes, etc. that she may owe?
Hi charlesreynolds!

Welcome to forums!

As far as I can understand, she had quitclaimed the property in your name and also included a life estate for her benefit. Thus, the property is in your and your wife's name. Thus, you are the sole owners of the property. In case there are any debts, you will have to pay it off.

Feel free to ask if you have further queries.

I don't know, check with an estate planning or tax attorney.
