Transferring property from a trust

Before my mother's death, she set up a trust of some farm ground to be split between myself and my 2 sisters. My mother passed away recently and we would like to get the property transferred out of the trust name. My sisters have agreed that they do not want the farm ground but are taking other family items instead. Can we use a quitclaim deed to transfer the farm ground into my name since everyone is in agreement? Do we have to involve a lawyer or can we do this ourselves?

As far as I know, others will be able to quitclaim the property in your name from the trust. It will be better if you can involve an attorney in this case. He/she will be able to tell you as well as others about the legal terms and conditions involved in the deed. Moreover, an attorney will also be able to draft the quitclaim deed for you. However, there are sample quitclaim deeds available online.

It depends on the terms of the trust. You need to read the trust documents. Also, you need to find out who the Trustee is, as that is the person that has the power to make any transfer.
