My older brother has clear warranty deed to 60acre farm with home. He also has serious health problems. He wants to put farm w/home in my name. Is a Qclaim deed or Warranty Deed the way to do this properly?
Hi Doug,
To put your name on the title to the farm, your brother can use the quitclaim deed. With this deed, you will be getting ownership rights over the farm.

Hi Doug,
If the property is completely lien free, then I think it will be better if you use the warranty deed for the transaction. This type of deed guarantees who the legal owners were before the transfer. But you will not get such a guarantee with a quitclaim deed.

yes i also agree that using a warranty deed would be better than quit claim deed as you get assurance that the title is free of any liens or claims.
