My father died in 2004 (georgia) and left his home to me under his Will. I am the Executrix of his estate. Everything has been handled except the transfer of this home to me. I did not transfer the property at the time of his death because I was going through a very nasty divorce and didn't want to add this property to the list of things my ex husband wanted. The home has a mortgage of about $95,000 with a fair market value of about $150,000. Due to a poor credit rating, I will be unable to get the mortgage refinaced. What are my rights in transferring this property if I can't secure a new mortgage.

if the probate has been complete, then the will needs to be recorded at the county recorder's office. this will help you in transferring the property in your name. once the property transfer is done, the lender will want you to refinance the loan in your name. you can contact your lender and check out if you can assume the loan.
