remortgaging but planning to divorce

Posted on: 03rd Nov, 2012 02:10 pm
ive been seperated for two yrs and have just decided to file for divorce. my husband wants to refinance and insists i sign the papers. how will this work during divorce procedings? i havnt signed remortgage papers yet.
Hi kat,

You should check out the documents carefully in order to find out whether or not you're liable for the mortgage payments. If you're liable for the payments, then don't transfer the property to your husband. If you do so, you may not remain the owner of the property but you will be liable for the mortgage payments.

Thanks

Hi kat!

Welcome to forums!

What papers does he wants you to sign? Check out the papers carefully before you sign on anything.

Feel free to ask if you've further queries.

That's a tricky one. Be very careful before signing anything and you should read out the papers thoroughly. In case, you are directly or indirectly responsible for making loan payments then you should think twice before signing because if your husband fails to make payments then the mortgage company will come after you also.
