My father died, leaving 1/3 of his estate to me, 1/3 to my sibling, and the remaining 1/3 to my nieces, 2 of whom are over 21 yrs old. Can I refuse to sell the house to my brother, and insist it be sold on the open market? What if the 2 nieces agree with me? Can we "out-vote" my brother, and force a public sale? We live in NY.

As it is a joint property first you need to give the offer to your co-owners. If they agree to your proposal then fine otherwise you can sell off the property in outside market. I would suggest you to consult with a real estate attorney before planning anything.

Thanks for your answers. What I mean is, can I PREVENT him from buying the property from the estate? I would rather see it go to a stranger, as it would be painful to have him living there.
