Hi,
I am wondering if someone has the answer to this question: How do I remove my ex-spouse from the title and loan if the ex-spouse can't be found. Divorce decree says that it acts as the legal document to get her off the title but I'm meeting resistance from my lender. The lender says over and over, "Just tell your attorney that all we need to see is two signatures and I guarantee he can fix this for you." When I repeat that the spouse is MIA, was a no-show for court dates, doesn't pay the child support that was also court ordered, and hasn't even seen her chidren in almost 3 years, they repeat the same information. I've already spent thousands on an attorney to have her out of the picture and now my lender is telling me that the order that I have from the court documenting that the property is mine is not sufficient. If you know the answer, I would very much appreciate the knowledge.

It is important that your ex-spouse signs the property deed in your favor and removes her name from it. Thus, the property would be transferred in your name. Then you would be able to refinance and remove her from the loan. In my opinion, your lender has given you the right suggestion. You need to speak to an attorney and get his opinion in this regard. He would be the best to let you know how you would be able to remove your ex-spouse's name from the property deed.
