My grandmother has a living estate in place and she is currently in the nursing home with no expectations of coming home. My mother has power of attorney over my grandmother and is executor of her estate. Years before my grandmother became ill she setup the living estate and added my mother, my uncle, and my uncle's wife to the deed of her home and property. My uncle passed before my grandmother went into the nursing home and she has a will naming my mother as the inheritor of the property, but both my uncle's name and his wife is still on the deed. What can we do in order to remove the names of my late uncle and his widow?
Hi neiger,
Your mother will have to file an affidavit of heirship and remove your uncle's name from the deed. As far as the uncle's widow is concerned, she will have to sign a quitclaim deed and transfer the property to your mother.
