Taking off decest husband off deed/title of house

MY husband and I are on the warranty deed and title of our home. He passed away and i want to remove his name.. I was told to fill out a Blank new Deed, need to get a letter of administration filed and realestate exise tax afidavid..I really need to do all this? and if I do where can i get these three forms ( especially the deed) and with whom exactly do i file it with? thank you so much ps / the house is paid for
Hi daseatfour,

You can file an affidavit of heirship at the county recorder's office. This will help you in removing your husband's name off the property deed. However, if your husband has left a will, then you will have to probate it. Once the probate is complete, the will needs to be recorded at the county recorder's office and then the property would be accordingly divided.

thank you so much, do i still need to do a new deed and letter of administration? no there was no will and there dont need to be a probate

Welcome back to forums!

As you will be filing an affidavit of heirship at the county recorder's office, I don't think you would require a new deed and a letter of administration. However, you may contact a real estate attorney and take his opinion in this regard.
