Removing a deceased grantor and adding a new one

Posted on: 30th Sep, 2010 05:33 pm
My family owns a parcel of vacant land in Wisconsin, my mom died, she was one of the owners, and left us with a huge debt. I want to remove her name and add mine, what do I need to do. My father is considering filing for bankruptcy will the transfer go through or will the creditors consider the transfer invalid and put a lien on the property.
Hi Guest,

You can remove your deceased mother from the property deed by filing an affidavit of heirship at the county recorder's office. However, as your father is planning to file bankruptcy, it will be better if you can take the bankruptcy attorney's opinion before filing the affidavit of heirship.

Thanks
