If a succession is open and you are trying to make repairs to the home. All members signed the first time, but the check came in all heirs names. The bank can't do it with all names. So, 2 members will not sign now. How can these names be removed with their rights still protected so the family home can be repaired after Hurricane Katrina. The power was given to one family member to take care of this by all members of the succession signing
Hi rarediamond
If the bank has given the check in the name of one particular family member, then he should now divide the whole amount amount among the other members of the family. He cannot use the money for his own benefit. If he does so, the other members will have the right to challenge him in the court of law.
Thanks.
