Real estate - how should courthouse papers read?

Posted on: 09th Jul, 2009 07:18 pm
I am an only child - my parents are 85 & 90 years old. They tell me they have added my name to the court house records . Would it be in everyone's best interest to remove their names from these records for asset protection and how does one go about doing this? too many questions - not enough answers

Thanks
Hi magnumsmom!

Welcome to forums!

Your parents can remove their name from the property deed by signing a quitclaim deed. If you remove their names rights now from the deed, you won't have to file an affidavit of heirship after they are deceased.

yes. they can remove their name by signing quit claim deed. it will save you from following legal procedure later on.

i am of the opinion that you might run into some problems if you attempt to change title to the home, removing your parents. i say that based on their elderly status - it would raise serious questions about their ability to make the proper decisions, etc.

you may be treading on thin ice - get legal assistance and be very careful. you don't want to make this too complicated, but you also don't want to be put in a position that will jeopardize you.
