THERES THREE OF IN THE DEED, THE ONE LIVING IN HOUSE DOES NOT PAY THE MORTAGE AND HAS ENCROCHED ON OUR LEGAL RIGHTS,IT'S BEEN FIFFICULT RESOLVING THE PROBLEMS BETWEEN US. THE HOUSE IS NOW IN FORCLOSURE. WHAT CAN WE DO TO REMOVE A FAMILY MEMBER FROM THE HOME WITHOUT COSTING US ALOT OF MONEY, IF WE REINSTATE THE HOUSE .

You have mentioned that the person who is not paying the mortgage is on the deed. This gives him/her the same right as the other two people have regarding the property. In order to remove him, you will have to ask him/her to sign a quitclaim deed in the name of other two members.

You can also try the option of "buying out co-owner". In case, the person doesn't sign the quitclaim deed in your favor, you can offer him/her a certain amount and ask to give away his/her interests in the property.
