Can I be removed from my deed

Posted on: 21st Dec, 2012 07:43 pm
I have been living in my home for about 2years(I was leasing it), I moved my fiance in a year ago, I have always paid the house note, and when he bought the house his name was on the mortgage and we hired a lawyer to put me on the deed, I have paid every mortgage payment, and he will not pay, we have been living together as husband and wife (common law) I wanted to know can he remove my name and put me out. He moved out and he keeps coming back harrassing me because his name is on the loan. what can I do?
no, he cant remove you from the deed and regrading the mortgage, all you have to do is to refinance it in your name. this way you'll remove your fiance's name from the mortgage.

lastly, do remember to consult a lawyer this time as well.

Hi Latrel,

As your name is mentioned on the property deed as one of the owners of the property, you will have equal rights to it just like your fiancée. He cannot force you to leave the property.

Don't get afraid. Your husband can't remove your name from the property title as you also hold ownership rights into it.

your husband can't remove your name from the property. you can only remove your name from the property through a quit claim deed.
