my name and my father name and mother name is on a property the quit claim deed doesn't say joint tenancy so i am assuming that we are tenant in common. my father has passed away and i would like to have the property quit claim to myself and my mother as joint tenancy. do i need to go to probate court to remove my father name off of the property. my father will his interest of the property to my mother. what papers do i need to fill out
If I am understanding your post correctly, your father had put that thet the home, in the event of his passing, is to be passed on to your mother. If that is the case, his interest in the property will be given to your mother. The best way to move forward from that point would be to do a Grant Bargain Sale Deed once his interest is transferred to your mother, and you may then equally transfer ownership of the property between your mother and yourself, assuming there are no difficulties or bad blood that would cause this action to be put on hold by your mother.
