How do I get my name on my husbands deed and morgage?

Posted on: 23rd Sep, 2009 12:10 pm
My husband and I got married 3yrs ago and he and his ex-wife owns the home we live in. She has finnally signed the Quick Claims Deed yesterday. What I am asking is now we have that form, how do we go about getting my name on the deed and on the morgage and get hers off? What are the steps we should take? And does she have any rights to the home now?
if she has transferred her ownership to him, then she has no ownership - it really is that simple.
if you would like to be responsible for the mortgage debt, the only way in which that's going to happen is if you refinance the existing mortgage. no lender is about to add someone to a note just because...
for you to become an owner of the home, your husband can do his own quit claim deed: from him to him and you.

If my husbnd signs a Quit Clam Deed over to me, doesn't that mean that he will no longer be an owner? We would like both of us as co-owners. And do we need to do that before we refinance the home?

Hi Michelle!

Welcome to forums!

If you and your husband want to be the co-owner of the property, then your husband will have to mention his name as the grantor of the property and both the names as grantee to the property. This will also help him remain as the co-borrower of the property. Once you do this, then you can refinance the mortgage in both the names.

Feel free to ask if you've further queries.

indeed...it would read something like this: "from Owner to Owner and Other Owner." insert your names in there.
