Can my dad remove my mom from our home mortgage without permission?

Hello all,

The house my family lives in is currently in my uncle's name as the primary and then my moms name as the secondary. My dad is in the process of getting a loan which has my uncle as the primary and himself as the secondary.

Can my father push this all through without my mother's consent? Can he do it if he forges her signature? Thank you.

Your father will not be able to remove your mother's name from the property deed without your mother's signature. If he does so, it will be considered as a fraud.

Thank you for your response. I found out from my mom that she is not on the deed. Her name is only on the mortgage. My uncle is on the deed and mortgage. Is it possible to change a mortgage without a loan officer coming to your house and visually identifying my mom with her driver's license?

Your mother's name is mentioned in the mortgage. If she wants to remove her name from the mortgage docs, then she will have to ask your uncle to refinance the loan in his name. Once he does so, her name will be removed from the mortgage docs.

Yes but the core of the question is, can she be REMOVED without her knowledge. Will the mortgage company verify that she actually wants to be removed by having a loan officer identify her using a drivers license during a mortgage signing?

Yes, with a forged signature and dishonest Notary.

No, that's the responsibility of the Notary. But all a Notary is suppose to do is confirm the person who is signing the Deed is actually who they say they are, and they usually use the Drivers License for that purpose.
