getting divorce and name on deed

Posted on: 20th Mar, 2010 11:46 am
my husband and his ex are both on the mortgage. she signed over a quit claim deed to him and he in turn put my name on the deed. now we are getting divorce and he says that i have no rights to the property or any monies from the sale of the house. can he remove my name from the deed without my consent? am i entitled to any compensation from the sale of the property?
Hi sainthomian,

Your husband will not be able to remove your name from the property deed or sell off the property without your consent or signatures. You need to sign a quit claim deed and transfer the property interest to him. If he sells off property with your name on the deed, then you are entitled to receive a portion of the sale price.
