Deed

My husband bought a home the loan was only in his name I didnt sign for the loan at all, But I had to sign the deed. Im looking to buy me a home now with out my husband he is willing to sign his dower rights so he will not be on the new home I am buying. about 3 months ago I hired a attorney to remove my name off the deed which is done now. When I go buy a home will I be consider as a first time buyer?

You would be considered a first time home buyer if you did not own a property in the last 3 years. You've removed your name from the property deed just 3 months back. In that case, you won't be considered a first time buyer now.

My name was never on the loan but because my name was on the deed I am not considered a first time buyer?

Hi meandyouRone,

As your name is on the deed, you won't be considered as a first time home buyer any longer. If you buy a new property, it would be considered as your second property or an investment property.

I had my attorney remove my name off my husband Deed three months ago now when I go check the Franklin county website I don't see my name on the house as I did before I had My name remove from that deed. So my question is this; How would a mortgage company know I ever had my name on a deed to not be consider as a first time buyer? Where can they find proof if I had it removed?

Hi meandyouRone,

You will be considered as a first time home buyer only if you did not own any property for 3 years. I won't be able to let you know how the lender would come to know about transfer of property. However, it's always better to let the lender know whether or not you owned any property. In case, you hide the fact and the lenders comes to know about it later on, he may penalize you for the same.
